§ 2 Scope

These general terms and conditions apply to all legal transactions between the provider “Mepassana Private Limited” and the consumer (in accordance with Section 13 BGB of a “natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed.

Furthermore, these general terms and conditions apply to all legal transactions between the provider “Mepassana Private Limited” and the entrepreneur, i.e. every natural or legal person or partnership with legal capacity who, when concluding the contract, acts in their commercial or independent activity.

§ 3 Vertragsabschluss und Speicherung des Vertragstextes

The provisions of these terms and conditions apply to course bookings that consumers conclude via the website www.mepassana.com.

The presentation and description of the events on www.mepassana.com does not constitute a contract offer. They merely represent an invitation to order. Errors excepted.

By registering the course by clicking on the “register” button at the end of the event description, a consumer makes a binding offer to conclude a purchase contract. The contract is only concluded when the seller sends a confirmation of participation by email.

By checking and agreeing to the terms and conditions by confirming with a tick in the field “I have read the terms and conditions and I agree to them. I was informed of my right of withdrawal ”by clicking the button“ register ”. After receiving the order confirmation by email, the contract is then concluded.

§ 4 prices / payment

In terms of Private Limited, sales tax is shown. All prices are gross prices. 

The following payment options are available to consumers:

Payment by credit card

Early Bird Prices

These are valid up to and including 21 days before the selected event. 

In the event that the declaration of withdrawal from the contract is used in the course of the Consumer Protection Act, the value paid will be reimbursed using the same means of payment. To process the reimbursement, it is necessary to present the payment confirmation and order confirmation that you received by email. 

§ 6 Trauma & Adventure Release and other events

The scope of services of the events corresponds to the content specified in the description. Mepassana Private Limited reserves the right to change the venue and course content according to weather conditions and participants' expectations without affecting the course of the event.

Information about the times of events only serves as a guide for the implementation within a period of time. These can change slightly.

Presence authorization:

Participation in an event is open to all adults over the age of 18 who are registered as participants.

When registering for a course via www.mepassana.com, the bookings are processed according to the order in which they are received.

After receiving the confirmation of participation, you will receive the document on the disclaimer for breathing work and trauma release from us. As soon as you have signed and sent this back to us, participation and your consent to all terms and conditions is contractually fixed.

Bookings up to a number of 10 people can only be taken into account. However, if you would like to attend an event on a certain date, please contact us using the request form so that we can personally discuss your participation.

Requirements for holding an event:

Any event of the courses on offer will generally only be held with a minimum of 4 participants. If fewer participants have registered, registered participants will be informed 10 working days before the start of the course. It is up to Mepassana Private Limted whether the event takes place with fewer participants than the minimum number of participants specified at the event. If the event does not take place on the scheduled date, the buyer has the option of a refund of the purchase price or can register for one of the next courses that will take place with the same course value. If the participant decides to attend a course other than the one previously selected and if its value is higher or lower, the difference must be settled at the venue. Payment by the buyer or reimbursement by Mepassana Private Limited. This also applies in the event of a short-term cancellation of an event due to illness by the organizer or force majeure that make the event impossible.

§ 7 revocation

Consumers have a fourteen-day withdrawal.

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

To meet the cancellation deadline, it is sufficient for you to send your notification of exercising your right of cancellation before the cancellation period has expired.

Consequences of the withdrawal

Mepassana Private Limited will reimburse you after receipt of the revocation and its verification after fourteen days from the day on which we received notification of your revocation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; In no case will you be charged any fees for this repayment. The repayment of the full amount is guaranteed within the fourteen-day right of withdrawal. If you cancel the contract outside of this period, due to illness, extra-natural circumstances, etc. and you are not able to travel and participate in the booked event, we reserve 10% of the event fee as an expense allowance.

§ 8 liability

If Mepassana Private Limited incurs personal injuries (injury to life, body and health) in the course of an event, Mepassana Private Limited will not assume any liability. Attending an event organized and carried out by us is at your own risk.

The liability is based on the general legal regulations.

Mepassana Private Limited assumes no liability for the distribution of materials and data by third parties in the course of the data voluntarily passed on to third parties during the event (photos and other information from participants that are disseminated in the media by other participants.

In the event of the dissolution of Mepassana Private Limited and the impossibility of holding events that have already been paid for by the participants, the liability for the performance of the contract will also expire. This means that no reimbursement of the event fees is possible.

§ 9 Warranty

The statutory warranty regulations apply.

§ 10 online dispute resolution and dispute resolution before consumer arbitration board
The so-called OS regulation or ODR regulation (ODR = Online Dispute Resolution) applies to the out-of-court settlement of disputes about contractual obligations from online sales contracts or online service contracts between consumers and entrepreneurs.
